A mother in Kazakhstan has won a legal battle to restore her son’s disability benefits after officials wrongly revoked them in 2021. The Zhetisu Regional Court ruled that the decision to strip the child of his disability status was unlawful and ordered the government to repay missed benefits. The child was first recognised as disabled in 2018 due to a severe congenital intestinal disorder. His status was extended until April 2021, but in May of that year, authorities declared he no longer qualified, cutting off state support.
The boy’s mother challenged the decision, arguing that his condition had not improved and that he still required constant care. She took the case to court, where judges found that the 2021 medical and social assessment had been carried out with excessive formalism. On review, the court overturned the May 14, 2021, ruling and ordered the restoration of disability payments from that date until July 17, 2024. The child was later reassessed and officially recognised as disabled again in 2024. The court’s decision is now legally binding.
The ruling means the family will receive backdated benefits covering the period from May 2021 to July 2024. The case also sets a precedent for how disability assessments must be conducted, ensuring fairer evaluations for other applicants in similar situations.
