Netto may continue offering extra discounts via app - German court upholds Netto's app-exclusive discount policy after legal battle
A German court has ruled that Netto can continue offering app-exclusive discounts. The decision came after a legal challenge by the Federation of German Consumer Organizations (vzbv). The Higher Regional Court in Bamberg dismissed the complaint, allowing the supermarket chain to keep its digital promotions.
The case centred on Netto's practice of providing a 15% discount only through its app. The vzbv argued that this approach unfairly excluded customers who did not use smartphones or the app itself. However, the court found the app accessible to all users aged 14 and older, with no legal requirement to adapt to individual preferences.
The judges also noted that app-based discounts could, in some cases, be more inclusive than traditional print advertising. They pointed out that digital access might benefit users who struggle with physical coupons or leaflets. Despite the ruling, there is no evidence that the decision has influenced similar cases in other German courts. No reports suggest that other companies or legal proceedings have been affected by this specific verdict.
Netto will maintain its app-only discount system following the court's approval. The ruling confirms that businesses can set digital conditions for promotions, provided the app remains widely accessible. For now, the case remains isolated, with no broader legal impact recorded elsewhere in Germany.
